Knowing Your Limits Under the Builders Lien Act

The Builders Lien Act provides a very useful tool in the toolbox of an unpaid subcontractor or trade contractor, but has set processes and timelines that must be followed in order to allow a subcontractor or trade contractor to avail itself of the Act’s rights and remedies. However, the Builders Lien Act is commonly misunderstood including with respect to certificates of completion, the claim of lien filing period and the holdback period.
